The establishment of the International Criminal Court (ICC) in 2002 marked a pivotal moment in international law, representing the global community’s commitment to ending impunity for the most serious crimes of concern to humanity: genocide, crimes against humanity, war crimes, and the crime of aggression. However, the Court operates within a complex and often contentious political and legal landscape. This course provides a comprehensive and critical examination of the ICC’s legal framework, its operational mechanics, and its role in the broader system of international justice.
Participants will explore the Rome Statute, the Court’s foundational treaty, and delve into the intricate procedures that govern its work—from initiating investigations and issuing arrest warrants to conducting trials and engaging with victims. The course goes beyond the black-letter law to address the real-world political challenges, diplomatic considerations, and ethical dilemmas that shape the Court’s efficacy and legitimacy. Through case studies of current situations and simulations, this program offers an unflinching look at the promise and perils of international criminal justice.
